Section 3 Technical Assistance

To ensure that new employment, training, and contracting opportunities generated from the expenditure of certain HUD funding are directed to low- and very low-income residents of the community where the funds are spent and the businesses that are either owned by, or substantially employ, these persons.

Uses and Use Restrictions

Funding is provided competitively to subsidize the administrative expenses associated with hiring coordinators to carry out day-to-day Section 3 responsibilities consistent with 24 CFR Part 135 for a period of one-year.

Eligibility Requirements

Applicant Eligibility

Any entity which receives Section 3 covered financial assistance directly from HUD.

Such entities include: any State, unit of local government, Public Housing Authority, Indian Tribe, other public body, or public or private nonprofit organization.

Applicants must be in compliance with the regulatory requirements of Section 3 in order to apply for competitive funding.

Beneficiary Eligibility

Public Housing Residents; Individuals residing in the metropolitan area or non-metropolitan county in which the Section 3 covered assistance is expended who is low- or very low-income as defined in Section 3(b)(2) of the 1937 Housing Act. Business Concerns that are either 51 percent or more owned by low-or very low-income residents; Business Concerns that substantially employ low-or very low-income residents; or Business Concerns that provide evidence of a commitment to subcontract in excess of 25 percent of the dollar award of all subcontracts to be awarded to business concerns that are either owned by or substantially employ low-or very low-income residents.

Costs for applicants will be determined in accordance with OMB Circular No. A-122. OMB Circular No. A-87 applies to this program.

Application Procedures

OMB Circular No. A-102 applies to this program. OMB Circular No. A-110 applies to this program. Applications must be submitted in accordance with requirements and forms provided in the Notice of Funding Availability as published in the Federal Register. State and local government applicants must use the standard forms as furnished by the Federal agency and required by OMB Circular No. A-102. Nonprofit entities and institutions of higher education must use standard forms as furnished by the Federal agency and required by OMB Circular No. A-110.

Award Procedures

Applications will be evaluated competitively and awarded points based on the Selection Criteria included in the published Notice of Funding Availability. The final decision rests with the Assistant Secretary for Fair Housing and Equal Opportunity or her/his designee.

Length and Time Phasing of Assistance

Funding is provided in accordance with requirements and forms provided in the Notice of Funding Availability and shall not extend beyond a 1-year (12 month) period. Assistance provided quarterly or as specified in the grant agreement. Method of awarding/releasing assistance: lump sum.

Recipient agencies must submit all reports required pursuant to OMB Circulars A-110 and A-133, and reporting under Form HUD 96010.

Audits

In accordance with the provisions of OMB Circular No. A-133 (Revised, June 27, 2003), "Audits of States, Local Governments, and Non-Profit Organizations," nonfederal entities that expend financial assistance of $500,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $500,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in Circular No. A-133.
