Highlands Conservation Act Grant Program FY 2018 - Base Funding

The Highlands Conservation Act (H.R.

1964, 2004; 16 U.S.C.

3901) is designed to assist Connecticut, New Jersey, New York and Pennsylvania in conserving land and natural resources in the Highlands Region through Federal assistance for land conservation projects in which a State entity acquires

credit:


land or an interest in land from a willing seller to permanently protect resources of high conservation value.

The USDA Forest Service (USFS) has identified lands that have high conservation value through the â¿¿New York New Jersey Highlands Regional Study:
2002 Update⿝ and the ⿿Highlands Regional Study:
Connecticut and Pennsylvania 2010 Update.⿝ Subject to availability of funds through Federal appropriation, each year, Governors of the four Highlands States may submit proposals for up to 50 percent of the total cost of land conservation projects in the Highlands Region.

Proposed projects must be consistent with areas identified in the Study and Update as having high resource value.

This program funds land conservation by State agencies in the Highlands Region.

Such acquisitions help create a conservation stewardship second only to Teddy Roosevelt by creating opportunities for more public access to lands.

State land acquisition increases access for recreational opportunities for the public, including hunting and fishing.

Additionally, the first purpose of the program (listed above) exemplifies the priority of utilizing our natural resources, such as drinking water, by recognizing their importance and conserving their utility for current and future generations of Americans.

Lastly, this program restores trust with our local communities through partnering with State agencies to fund state and local projects.

Additional Information of Eligibility:
Eligible Applicants: A State educational agency (SEA); a high-need LEA; a for-profit or nonprofit organization that has a proven record of effectively recruiting and retaining highly qualified teachers, in partnership with a high-need LEA or an SEA; an IHE in partnership with a high-need LEA or an SEA; a regional consortium of SEAs; or a consortium of high-need LEAs.

Each application must identify participating LEAs that meet the definition of ``high-need LEA'' in section 2102(3) of the ESEA.

Note: Section 2102(3) of the ESEA defines a high-need LEA as an LEA-- (a) That serves not fewer than 10,000 children from families with incomes below the poverty line (as that term is defined in section 9101(33) of the ESEA), or for which not less than 20 percent of the children served by the LEA are from families with incomes below the poverty line; and (b) For which there is (1) a high percentage of teachers not teaching in the academic subjects or grade levels that the teachers were trained to teach, or (2) a high percentage of teachers with emergency, provisional, or temporary certification or licensing.

The NFP describes how applicants must demonstrate that a participating LEA meets this statutory definition of ``high-need LEA'' (69 FR 24002, 24006).

Pursuant to the NFP, we provide the following supplementary information regarding the data an applicant uses to demonstrate eligibility as a ``high-need LEA'' under this competition: As described in the NFP, absent a showing of alternative LEA data that reliably show the number of children from families with incomes below the poverty line that are served by the LEA, the eligibility of an LEA as a ``high-need LEA'' under component (a) of the definition must be determined on the basis of the most recent U. S. Census Bureau data.

The Department examines the eligibility of any LEA not listed on these charts on a case-by-case basis.
