Additional Information of Eligibility:
To be eligible for SCSEP National Grant funding under this FOA, an applicant must be a non-profit organization, Federal public agency, or Tribal organization that demonstrates the ability to administer a multi-state SCSEP program (20 CFR 641.400(a)), as specified in section II.A.4.

The Department reserves the right to award a grant to only one applicant per State, and to award an applicant funds to serve only one state.

This does not, however, permit an applicant to apply to provide services in only one state.

In keeping with the direction provided by Congress under the OAA, as amended, the following organizations are eligible to apply for SCSEP National Grant competition funding:Non-Profit Organizations: A “Nonprofit organization” is an agency, institution, or organization which is, or is owned and operated by, one or more corporations or associations of which no part of the net earnings inures, or may lawfully inure, to the benefit of any private shareholder or individual (42 U.S.C.

§ 3002(39)).Federal Public Agencies: Federal agencies must demonstrate that they have the statutory authority to receive other Federal grant funds (also known as gift authority) – see Section IV.B.4.a.4.Tribal Organizations: “Tribal organizations” are the recognized governing body of any Indian tribe, or any legally established organization of Indians which is controlled, sanctioned, or chartered by such governing body [42 U.S.C.

§ 3002(56)].

“Indian tribe” means any tribe, band, nation, or other organized group or community of Indians (including Alaska Native village or regional or village corporation as defined in or established pursuant to the Alaska Native Claims Settlement Act) which: (A) is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians; or (B) is located on, or in proximity to, a Federal or State reservation (42 U.S.C.

§ 3002(27) and 20 CFR 641.140).
