The Department of the Interior protects and provides access to the Nation's natural and cultural heritage, including responsibilities to Indian tribes and island communities. Departmental goals include resource protection and usage, overseeing recreational opportunities, serving communities and excellence in management.

Uses and Use Restrictions
The Ebey s Landing National Historical Reserve was established in 1978 "to preserve and protect a rural community which provides an unbroken historical record from nineteenth century exploration and settlement in Puget Sound to the present time." (National Parks and Recreation Act 1978, PL 95-625).
The Trust Board of Ebey s Landing National Historical Reserve was established to manage and administer the Reserve.
The Trust Board is comprised of nine members, from Island County (3), Town of Coupeville (3), State Parks (1), and the National Park Service (1).
Discretionary appropriated funds shall be made available for Task Agreements on a case-specific basis.

The authorizing legislation for Ebey s Landing National Historical Reserve states that the Secretary of Interior is authorized to transfer management and administration of the Reserve to an appropriate unit of local government.
A joint administrative board called the Ebey s Landing National Historical Reserve Trust Board (Trust Board), was created in accordance with the provision of RCW 39.34.030.
The Trust Board consists of nine members: Three representatives of Island County, residing in the Reserve, three representatives from the Town of Coupeville, one [Washington] State Park representative, and one National Park Service representative.
The Trust Board complies with the Open Public Meeting Act Chapter 42.30 RCW and members of the Trust Board are enrolled as Volunteers in Parks (VIP).

Preapplication Coordination
All funded projects will be developed collaboratively between the National Park Service and the Trust Board and executed in accordance with availability of appropriations, application law and regulations including DOI Regulations regarding Financial Assistance awards at 43 CFR Part 12.

Application Procedures
This program is excluded from coverage under OMB Circular No. A-102. OMB Circular No. A-110 applies to this program. Projects will be documented in task agreements to be issued under the terms and conditions of a master Cooperative Management Agreement. Each project will include the appropriate documentation for a Financial Assistance award in accordance with National Park Service and DOI policy and regulation.

Projects will be selected based on criteria developed with the partners and as approved by the Deputy Regional Director, Pacific West Regional Office. All awards will be made in accordance with Department of Interior Policy, Departmental Manual 505DM2 based upon Unique Qualifications.

16 USC §1g provides that the National Park Service may enter into cooperative agreements that involve the transfer of National Park Service appropriated funds to State, local and tribal governments, other public entities, educational institutions, and private nonprofit organizations for the public purpose of carrying out National Park Service programs pursuant to 31 U.S.C. 6305 to carry out public purposes of National Park Service programs.
The Outdoor Recreation Act, as amended, 16 U.S.C.,4601-1(f), (1988), states that the Secretary is authorized to sponsor, engage in, and assist in research, undertake studies through cooperative agreements, and cooperate with educational institutions in establishing educational programs and activities relating to outdoor recreation.
PL 95-625 authorizes the Secretary of Interior to transfer management and administration of the Reserve to an appropriate unit of local government, known as the Ebey s Landing National Historical Reserve. The Comprehensive Plan for the Reserves calls for a Cooperative Agreement between Island County, the Town of Coupeville, the Washington State Park and Recreation Commission (State Parks), and the United States Department of the Interior.
The Interlocal Cooperation Act (Chapter 39.34 RCW) permits local governmental units to enter into joint powers agreements with each other, with State Parks and the National Park Service (RCW 39.34.030).

Statutory formulas are not applicable to this program.
Matching Requirements: The US Department of the interior through the National Park Service shall request an appropriation through customary budgetary procedures to defray a portion - not to exceed 50%--of annual operational costs of the Reserve. The remaining costs, which may consist of direct financial contributions or in-kind services, will be provided for from other sources.

2. Non-Discrimination - All activities pursuant to this Agreement shall be in compliance with the requirements of Executive Order 11246; Title VI of the Civil Rights Act of 1964, as amended, (78 Stat. 252; 42 U.S.C. §§2000d et seq.); Title V, Section 504 of the Rehabilitation Act of 1973, as amended, (87 Stat. 394; 29 U.S.C. §794); the Age Discrimination Act of 1975 (89 Stat. 728; 42 U.S.C. §§6101 et seq.); and with all other federal laws and regulations prohibiting discrimination on grounds of race, color, sexual orientation, national origin, disabilities, religion, age, or sex.

Lobbying Prohibition - 18 U.S.C. §1913, Lobbying with Appropriated Moneys, as amended by Public Law 107-273, Nov. 2, 2002 - No part of the money appropriated by any enactment of Congress shall, in the absence of express authorization by Congress, be used directly or indirectly to pay for any personal service, advertisement, telegram, telephone, letter, printed or written matter, or other device, intended or designed to influence in any manner a Member of Congress, a jurisdiction, or an official of any government, to favor, adopt, or oppose, by vote or otherwise, any legislation, law, ratification, policy, or appropriation, whether before or after the introduction of any bill, measure, or resolution proposing such legislation, law, ratification, policy, or appropriation; but this shall not prevent officers or employees of the United States or of its departments or agencies from communicating to any such Members or official, at his request, or to Congress or such official, through the proper official channels, requests for legislation, law, ratification, policy, or appropriations which they deem necessary for the efficient conduct of the public business, or from making any communication whose prohibition by this section might, in the opinion of the Attorney General, violate the Constitution or interfere with the conduct of foreign policy, counter-intelligence, intelligence, or national security activities. Violations of this section shall constitute violations of section 1352(a) of title 31.
4. Anti-Deficiency Act - 31 U.S.C. §1341 - Nothing contained in this Agreement shall be construed as binding the NPS to expend in any one fiscal year any sum in excess of appropriations made by Congress for the purposes of this Agreement for that fiscal year, or other obligation for the further expenditure of money in excess of such appropriations.
5. Minority Business Enterprise Development - Executive Order 12432 - It is national policy to award a fair share of contracts to small and minority firms. The NPS is strongly committed to the objectives of this policy and encourages all recipients of its Cooperative Agreements to take affirmative steps to ensure such fairness by ensuring procurement procedures are carried out in accordance with 43 CFR §12.944 for Institutions of Higher Education; Hospitals and other Non-Profit Organizations, and 43 CFR §12.76 for State and Local Governments.
