U.S. Magistrate Judge David G. Bernthal says that Sherman can not just sue the state because he is against a cross. The judge then granted the dismissal.
Sherman then appealed to the 7th Circuit Court of Appeals in Chicago, but the panel of justices suggested that even if the cross is a religious symbol, the cross is also considered to be a tourist attraction.
